Criminal appeals and white-collar defence

Appellate and revisional work in criminal matters.

Appellate criminal work means reviewing the trial record for errors of law and fact: whether the evidence proves each ingredient of the offence, whether the witnesses are consistent, and whether the procedure was followed. The High Court can also quash proceedings that should not continue, under section 528 of the Bharatiya Nagarik Suraksha Sanhita (formerly section 482 of the CrPC).

Cases under the Prevention of Corruption Act, often investigated by the CBI or a state vigilance department, turn on specific proof such as demand and acceptance. An appeal against conviction is usually filed with an application to suspend the sentence while the appeal is pending.

Typical matters

  • Appeals against conviction under the Prevention of Corruption Act
  • Cases investigated by the CBI
  • Quashing of proceedings (s.482 CrPC / s.528 BNSS)
  • Criminal revisions

Documents usually relevant

Matters of this kind usually involve the FIR, the charge-sheet, the trial court judgment and order on sentence, and any bail orders.
