Service law covers disputes between employees and their employers where the employer is the State, a public body, or an institution bound by statute, such as a recognised school. Common matters include withheld pay-commission arrears, denial of leave or benefits, disciplinary action, and orders on transfer, promotion or retirement dues.
In Uttarakhand, service matters of state employees and staff of aided and recognised institutions are usually filed as writ petitions before the High Court at Nainital, often after a representation to the employer has gone unanswered. Where a court order has already been passed and is not being followed, a contempt petition is the usual next step.
